These Terms & Conditions (“Terms”) govern your use of the website, the newsletter, the community, and all products, courses, sessions, and services offered by Matthew Gottesman LLC, operating as The Niche Is You® (the “Company,” “we,” “us,” or “I”).
By accessing the site, subscribing, or purchasing anything, you agree to these Terms and to the Privacy Policy. If you don’t agree, please don’t use the site or the offers.

You must be at least 18 years old and able to enter a binding contract to purchase any product, membership, cohort, or session. By buying, you confirm that you meet this requirement and that the information you provide is accurate.
You’re responsible for keeping your account credentials secure and for all activity that happens under your account.

Depending on what you sign up for, the offers may include:
The newsletter — free and paid writing delivered by email.
The community — a membership space for people building voice-first work.
The Practice — one-on-one advising, offered as single sessions or custom engagements shaped to your needs.
The Sovern Writer — a live, cohort-based program.
Products — digital and physical goods released from time to time.
Details, formats, and pricing for each offer are described where it’s sold. I may add, change, or discontinue offers at any time.

Prices are listed at the point of purchase and may change over time. The price you agree to at checkout is the price that applies to that purchase.
Payments are processed securely by our third-party payment processor. By purchasing, you authorize the charge to your chosen payment method.
Subscriptions renew automatically at the interval shown (for example, monthly or annually) until you cancel. You authorize recurring charges until cancellation.
You’re responsible for any applicable taxes and for keeping your payment details current.

Some offers may be available on a payment plan. If you choose to pay by installments, you’re committing to the full fee for that offer — not buying a per-installment right to cancel. By selecting a plan, you authorize each scheduled installment to be charged on its due date.
Remaining installments stay payable in full whether or not you attend, complete, or withdraw. If a payment fails or is missed, I may pause or withdraw your access to the offer, community, and materials until it’s resolved, without affecting the amount you still owe.

All sales are final. Payments for The Sovern Writer cohort and The Practice (single sessions and custom engagements) are non-refundable — including for missed sessions, unused portions, or a change of mind after purchase. Please make sure an offer is right for you before you buy; reach out with questions first.
For subscriptions, cancelling stops future renewals but does not refund the current billing period. Where a refund is ever offered, it is at my sole discretion and is not a waiver of this policy. Nothing here limits rights you may have that cannot be waived under applicable law.

Subscriptions — you can cancel anytime; access continues until the end of the paid period, and it won’t renew after that.
Rescheduling — you may reschedule a session at no charge up to 24 hours before its scheduled start. Email me as early as you can.
Late cancellations & no-shows — cancelling within 24 hours of a session, or not attending without notice, counts as a used session; no refund or replacement is provided.
Session expiry — where an engagement includes multiple sessions, they must be booked and used within the window stated at purchase (or, if none is stated, within 6 months). Unused sessions after that are forfeited. Extensions are at my discretion in exceptional cases.
Cohorts— once a cohort is purchased, your seat is reserved and payment is non-refundable, regardless of attendance.

The community only works if it stays a place worth being in. When participating, you agree to:
Treat others with respect — no harassment, hate, or personal attacks.
Keep it relevant and constructive — no spam, solicitation, or self-promotion outside designated spaces.
Respect privacy — don’t share other members’ words or information outside the community without permission.
Follow the law and any additional community guidelines posted in the space.
I may remove content or suspend or terminate access — without refund — for conduct that violates these Terms or harms the community.

Live sessions, calls, and community discussions may be recorded so participants can revisit them. By joining a session, cohort, or the community, you consent to being recorded, and you acknowledge that recordings are owned by the Company and provided for your personal use only — they may not be shared or distributed.
Sessions and the community may involve seeing other people’s work, questions, and situations. You agree to keep anything personal, professional, or confidential that others share private, and not to reproduce or use it outside the space.

All content — writing, courses, session materials, recordings, frameworks, designs, the name The Niche Is You®, and related marks — is owned by the Company or its licensors and protected by intellectual property law.
When you purchase an offer, you receive a personal, non-transferable, non-exclusive license to access and use the materials for your own use. Without my written permission, you may not:
copy, publish, distribute, sell, license, or share paid materials with any third party;
use the materials, frameworks, or methodologies to create, market, or sell a competing course, program, community, or coaching offer; or
teach or present the frameworks or methodologies to others for payment.
This section survives the end of, or your withdrawal from, any offer.

Anything you post or submit in the community or during a session remains yours. By sharing it, you grant the Company a non-exclusive license to display and use it as needed to operate the community and deliver the service. You’re responsible for what you share and confirm you have the right to share it.

The work is educational and informational. It reflects my experience and opinions, and is not professional, legal, financial, medical, or tax advice.
I share strategies and frameworks that have worked for me and others — but results depend on you, your effort, and factors outside anyone’s control. I make no guarantee of any specific outcome, income, audience growth, or success. Any examples are illustrations, not promises.

The offers rely on third-party platforms (for example, for the newsletter, community, and payments). Your use of those platforms is also subject to their terms. I’m not responsible for their availability, actions, or policies, and links to other sites are provided for convenience only.

The site and all offers are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. I don’t warrant that the site will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, the Company will not be liable for any indirect, incidental, consequential, or punitive damages, or for lost profits or lost opportunities, arising from your use of the site or the offers.
My total liability for any claim relating to an offer will not exceed the amount you paid for that offer in the twelve months before the claim.

You agree to indemnify and hold harmless the Company and its team from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the site or offers, your violation of these Terms, or your infringement of anyone’s rights.

These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Arizona, and you consent to their jurisdiction.
Before filing anything, please contact me — most issues can be resolved directly and in good faith.

I may update these Terms as the work evolves or the law changes. When I do, I’ll revise the “last updated” date above. Continued use after an update means you accept the revised Terms.

If any part of these Terms is found unenforceable, the rest still applies. My not enforcing a provision isn’t a waiver of it. These Terms, together with the Privacy Policy and any offer-specific terms, are the entire agreement between us.
